Estudo de caso: exclusão do direito sucessório por indignidade

Abstract

Existem diversos aspectos legais referente aos direitos vinculados à herança, trazendo, consigo, a ideia da necessidade do vínculo afetivo entre o de cujus1 e os herdeiros e legatários, sendo pouco pautado as circunstâncias geradas pelos sucessores ao querer adiantar o espólio e as ações realizadas no momento que se consegue auferir isso. O trabalho em questão tem, por sua vez, trazer o entendimento de que a aquisição da herança não se trata de um direito absoluto, visando mostrar os métodos processuais que tendem a ser realizados no momento que a análise de inventário é efetuada até o requerimento da exclusão. Este estudo monográfico tem como crucial referência teórica, os princípios da Constituição Federal de 1988, sobretudo os artigos do Código Civil que firmam as teses do tema e do caso tratadoThere are several legal aspects regarding the rights linked to inheritance, bringing with them the idea of the need for an emotional bond between the deceased and the heirs and legatees, with little attention given to the circumstances generated by the successors when wanting to advance the estate and the actions carried out in the moment when this can be achieved. The work in question has, in turn, brought the understanding that the acquisition of inheritance is not an absolute right, aiming to show the procedural methods that tend to be carried out at the time that the inventory analysis is carried out until the request for exclusion. This monographic study has as its crucial theoretical reference the principles of the 1988 Federal Constitution, especially the articles of the civil code that establish the theses of the topic and the case discussed.
