Resumo
O presente trabalho analisa o papel das Ações Diretas de Inconstitucionalidade (ADI)
na proteção dos direitos fundamentais e na consolidação do Estado Democrático de Direito.
Com as ADIs o Supremo Tribunal Federal (STF) assegura a supremacia da Constituição
Federal, invalidando leis e atos normativos incompatíveis com seus princípios. A pesquisa, de
caráter bibliográfico, descritivo e de campo, combinou abordagens para examinar os efeitos
jurídicos, políticos e sociais das ADIs. Verificou-se que, embora esse instrumento tenha
promovido diversos avanços relevantes — como nos casos das uniões homoafetivas e da
educação inclusiva —, ainda enfrenta desafios como a morosidade processual, o ativismo
judicial e o excesso de decisões monocráticas. Conclui-se que o fortalecimento das ADIs exige
maior transparência, colegialidade e participação social, assegurando uma atuação do STF mais
democrática, responsável e comprometida com a efetividade dos direitos fundamentais.

This current work analyses the role of the Direct Actions of Unconstitutionality (DAU)
in the protection of fundamental rights and consolidation of the Democratic State of Law. With
the help of the DAU the Supreme Court secures the supremacy for the Constituition,
invalidating laws and normative acts that mismatch its principles. The research, of
bibliographic, descriptive and field character, has combined different approaches to examinate
the legal, political and social effects of the DAU. It was verified that, despite this instrument
having promoted relevant advances — such as in same-sex marriage and inclusive education
—, it still faces challenges, like procedural slowness, legal activism and the excess use of
unilateral decisions. In conclusion the strengthening of the DAU demands more transparency,
collective choices and social action, ensuring a more democratical, responsible performance of
the Supreme Court towards the effectiveness of the fundamental rights.
