Estupro marital.

Abstract

O presente trabalho aborda o crime de estupro, que é cometido dentro do casamento, denominado “estupro marital”, com ênfase na questão de o sexo ser ou não ser uma obrigação dentro da relação conjugal, os costumes relacionados a essa prática e como pode ser difícil comprovar tal crime. Expõe toda a fundamentação teórica, como seu conceito, natureza jurídica, evolução histórica, tipificação legal e direito comparado. Como meio de analisar o conhecimento do tema abordado, o trabalho traz, ainda, uma pesquisa de campo com a população regional e especialista na área.

The present work deals with the crime of rape that is committed within marriage, called “marital rape”, with emphasis on whether or not sex is an obligation within the marital relationship, mores related to this practice and how it can be difficult to prove such a crime. It exposes all the theoretical foundation, such as its concept, legal nature, historical evolution, legal typification and comparative law. As a means of analyzing the knowledge of the topic addressed, the work also brings a field research with the regional population and specialist in the area.
