As funções da pena de prisão

Abstract

O encarceramento é um assunto bastante debatido nos dias atuais. Neste trabalho, discutimos a origem e a evolução da pena como resposta à violência; as ideias de justiça e sensação de justiça; a pena de prisão como resposta equilibrada no lugar da vingança, da mutilação, da pena de morte e de outras punições extremas; a manutenção da ordem social; o laxismo penal.Imprisonment is a hotly debated issue these days. In this paper, we discuss the origin and evolution of punishment as a response to violence, the ideas of justice and sense of justice, the prison sentence as a balanced response in the place of revenge, mutilation, the death penalty and other extreme punishments, the maintenance of social order and the criminal laxism.
