Alimentos gravídicos.

Abstract

O presente trabalho tem por objetivo, não só ressaltar a importância da inovação trazida pela Lei 11. 804, de 05.11.2008 que disciplina o direito a alimentos gravídicos e a forma como ele será exercido e dá providências, mas também analisar o importante instituto da personalidade jurídica do nascituro, suas teorias, e seu início dentro do ordenamento brasileiro. O estudo buscou demonstrar os aspectos materiais e processuais da Lei de Alimentos Gravídicos, sem deixar de lado as eventuais controvérsias sobre o assunto, fazendo para tal uma análise crítica e detalhada do assunto. Por fim foram identificadas teorias acerca do assunto, soluções às problemáticas demonstradas e elaboração de questionário sobre o tema.The present work aims not only to emphasize the importance of innovation brought by Law 11. 804, of 05.11.2008 that disciplines the right to pregnancy food and the way it will be exercised and gives measures, but also analyze the important institute of the legal personality of the unborn child, its theories, and its beginning within Brazilian order. The study sought to demonstrate the material and procedural aspects of the Article Food Act, without leaving aside any controversies on the subject, making for this a critical and detailed analysis of the subject. Finally, theories about the subject were identified, solutions to the problems demonstrated and preparation of a questionnaire on the subject.
