Inovação tecnológica no judiciário: o direito eletrônico

Abstract

O Direito eletrônico na área processual é uma realidade imutável e, vem revolucionando o Sistema Judiciário com suas inovações técnicas. Os avanços na área de Tecnologia da Informação trazem suas consequências para o Direito, ou seja, contribui diretamente para o desenvolvimento de nossas instituições. O aperfeiçoamento da informática traz mudanças constantes nas atividades processuais, tanto tecnicamente, quanto em melhorias nas atividades sociais, entretanto, os crimes digitais ainda são um empecilho nas plenas atividades do judiciário. Por isto, são necessárias: a Certificação eletrônica, assinaturas digitais e segurança digital, como uns dos procedimentos de segurança contra fraudes e crimes eletrônicos. Neste trabalho, o enfoque foi para as inovações tecnológicas e a parte que se refere a legislação e aos crimes cibernéticos serão abordados com caráter informativo e de prevenção.The Electronic law in the trial area is an unchangeable reality and has revolutionized the Juridical System with its technical innovations. The improvement in the area of ​​Information Technology brings about its consequences for Law, or better, it contributes for the development of our institutions. The improvement of the informatics brings the constant changes in the trial activities, both in technology and in improvement in the social activities. However, digital crimes are still a problem in the activities of Judiciary. That is the reason for the necessityt of electronic Certification and digital signatures as some of the security procedures against frauds and electronic crimes. In this issue, the focus goes to the technological innovations and what refers to the legislation and cybernetic crimes which will be presented as informative and with prevention propose.
