Resumo
No transtorno de personalidade antissocial existe um padrão de desprezo,
frieza, mas consciência de seus atos. Apesar de terem ciência de tais atos não os
pode controlar, o que torna os portadores desse transtorno semi-imputáveis, pela lei,
e podem ter sua pena reduzida, ou sofrer internação em hospitais, como medida de
segurança. O poder judiciário passa por desafios quando se trata dos efeitos penais
aos psicopatas, pela falta de tal punibilidade, e de uma legislação especifica, o que a
deixa ineficaz, pela maioria das punições serem de cadeia comum. Diante das
informações descritas, chega-se à conclusão que deve ser aplicadas penas a essas
infrações, e não medidas de segurança com atenção em que o convívio com demais
presos, pode-se causar piores efeitos para a sociedade e o sistema prisional, e para
que essas sanções sejam devidamente aplicadas deve ser diagnosticado o transtorno
através de exames psiquiátricos, pois os mesmos não se arrependem de seus feitos,
e uma medida falha os levaria a pratica-los novamente.
In antisocial personality disorder there is a pattern of contempt, coldness, but awareness of their actions. Although they are aware of such acts, they cannot control them, which makes the sufferers of this disorder semi-imputable, by law, and may have their penalty reduced, or suffer hospitalization as a safety measure. Given the information described, it is concluded that penalties should be applied to these offenses, not security measures with attention that living with other prisoners, can cause worse effects to society and the prison system, and to If these sanctions are properly enforced the disorder should be diagnosed through psychiatric examinations, as they do not regret their deeds, and a faulty measure would lead them to practice them again.
