Psicopatia e o Direito Penal

Abstract

Este artigo tem como enfoque tratar sobre as relações punitivas dos indivíduos que possuem transtorno psicopático e visa também responder algumas questões que, para a maioria da sociedade não são totalmente claras, como por exemplo qual o tipo de punição estes indivíduos devem receber. É abordado sobre os tipos de psicopatas e seus níveis com o cunho informativo para que ao ler este artigo, pessoas aprendam a identificar quando houver alguém parecido ao seu redor ou fazendo parte do seu convívio. Visto que os psicopatas tem um tratamento “especial” quanto aos outros criminosos, é também aludido neste artigo sobre a culpabilidade dos mesmos e quais os reais meios existentes para puni-los. Estatísticas e os projetos de lei vêm para informar sobre a situação e mostrar quais as leis vigentes sobre o assunto em questão a fim de retirar qualquer dúvida possível existente. This article focuses on dealing with the punitive relationships of individuals who have psychopathic disorder and also aims to answer some questions that, for most of society, are not entirely clear, such as what type of punishment these individuals should receive. It is approached about the types of psychopaths and their levels with an informative nature so that when reading this article, people learn to identify when there is someone similar to them or being part of their life. Since psychopaths have a “special” treatment besides other criminals, it is also alluded in this article about their guilt and what are the real ways to punish them. Statistics and bills come to inform about the situation and show which laws are in force on the matter in question in order to remove any possible doubt existing.
