A utilização de células tronco embrionárias à luz do direito.

Abstract

As pesquisas que envolvem células-tronco vêm sendo aprimoradas a cada ano no cenário nacional e mundial, apresentando resultados que geram hipóteses incríveis. Os cientistas e pesquisadores desta área criam métodos inovadores que facilitam no tratamento de algumas doenças e traumas. O problema ao falar sobre esse assunto é que ainda há certa rejeição da sociedade com relação aos métodos empregados pelos médicos e cientistas na retirada das células-tronco de embriões. Apesar de existir uma legislação específica que versa sobre o assunto e uma série de decisões dos Tribunais Superiores brasileiros em conformidade com esses métodos, existem ainda muitas divergências sobre o tema dentro dos diversos grupos sociais. No decorrer da pesquisa, discorreremos sobre pontos importantes dentro do Direito que se relacionam ao tema, dando ênfase na questão: quando a vida começa? O principal objetivo deste trabalho é justamente apresentar os aspectos deste conflito e os seus fundamentos, além de pacificar as ideias sobre o assunto, respeitando, ao mesmo tempo, as legislações sobre células-tronco embrionárias e a ética social, na medida do possível.The research that involving stem cells has been improved year after year in the world's and national scenary, showing results that generates amazing hypotheses. The researchers from this area has been created new methods that is making some diseases and injuries treatments easier. The problem about talking of this topic is the rejection of the society, that remains until today. This rejection is about the methods applied by the researchers on taking this stem cells off of the embryo. Allthough we already have a legislation on this topic, besides the decisions of the brazilian High Courts, there are a lot of disagreements about the subject among the many social groups. Throughout the research, we are going to discuss on important points within the Brazilian Law which relate to the theme, emphasizing the key issue: When life begins? Our main goal it's to show the aspects of this conflict and their fundamentals, apart from pacify the ideas about the topic, respecting, at the same time, the legislation about embryonic stem cells and social ethics, as far as possible.
