A lei Maria da Penha e a ineficácia das medidas protetivas de urgência

Abstract

O artigo visa discorrer sobre a lei 11.340, mais conhecida como lei Maria da Penha, trazendo um olhar sobre a relevância da lei e das medidas protetivas de urgência, uma vez que por mais que os aparatos jurídicos sejam efetivos, ainda existem casos de violência, sendo necessário reforçar e repensar, tanto na aplicabilidade quanto na estipulação de termos. A metodologia usada é de fontes secundárias e quantitativas,e analisando de pesquisas realizadas, bem como artigos, livros e doutrinas, as pesquisas secundárias apontam para pontos que carecem de melhoria. Por fim, conclui-se a necessidade de uma melhoria no investimento de infraestrutura e apoio na linguagem no momento do requerimento, também uma simplificação da burocracia, entre outros meios propostos no artigo.The article aims to discuss the law 11.340, better known as the Maria da Penha law, also bringing a look at the relevance of the law and its mechanisms, in this case the emergency protective measures, since as much as the legal apparatuses are effective, there are still cases of violence and the breakdown of the measures occurs, It is necessary to reinforce and rethink the effectiveness of the measures, both in applicability and in the stipulation of terms. The methodology used is secondary and quantitative sources that seeks analysis of research carried out, as well as articles, books and doctrines, showing that secondary research points to points that need improvement. Finally, it is concluded that there is a need for an improvement in the investment of infrastructure and support in the legal language at the time of the request, as well as a simplification of the bureaucracy of evidentiary documents, among other means proposed in the article for the advancement and effectiveness of the law and its innovations.
