Assédio moral no trabalho.

Abstract

O Trabalho de Conclusão de Curso é referente ao assunto assédio moral no trabalho, que é considerado uma forma de abuso e caracteriza-se por situações humilhantes e constrangedoras, repetitivas e prolongadas, praticadas contra um subordinado por parte de um subordinante ou mesmo por parceiros de trabalho. Essa ofensa deve ser clara e objetiva, causando constrangimento em quem é assediado. Desse modo, não é considerado assédio moral qualquer situação corriqueira. Tais humilhações podem gerar graves danos à saúde física e mental do indivíduo, comprometendo sua própria identidade ou até mesmo levá-lo ao suicídio. Analisamos dispositivos legais que regem tal ato e encontramos artigos que punem, de certa forma, o agressor. Ou seja, não há, no ordenamento jurídico, leis federais que tratam do assédio moral como algo específico, apesar de existirem muitos projetos de lei acerca do assunto. No entanto, as condutas praticadas pelo autor do assédio moral são coibidas e punidas por textos constitucionais e infraconstitucionais.The End of Course Work related to the subject bullying at work, which is considered a form of abuse and is characterized by humiliating and embarrassing, repetitive and enduring situations, committed against a child by a tying or even co-workers. We analyze legal provisions governing such an act, and found articles which somehow punish the offender. Ie there is, in the legal system, federal laws that deal with bullying as something specific, although there are many bills on the subject. However, the acts committed by the author of bullying are restrained and punished for constitutional and infra-constitutional texts.
